5 Important Things to Remember Before Calling Your Appellate Printer by Eric Larke

1. Carefully determine your appellate status. Are you the only appellant, or are there additional parties to the appeal? It’s possible you are a Co, Cross, or Concurrent Appellant. Make sure you include all notices of appeal.

2. When proceeding on the Appendix Method, do not omit documents that your adversary would rely upon. Rather, in the event you believe they will rely on these documents, you should include them.

3. When preparing your Request for Appellate Division Intervention Form in the Appellate Division, Second Department, do not assume all other parties are Respondents. Carefully fill out the forms so that their proper designation is reflected.

4. Make sure you furnish your printer with the papers just as they were filed in the lower court. Since our role often starts with receipt of the lower court documents, we have limited knowledge as to the integrity of the papers provided. It is important that the printer receives documents identical to the ones that were filed in the court of original instance.

5. The Appellate Division requires a $315.00 filing fee. Remember to account for this fee prior to your due date.
